Terms and Conditions of Service

IMPORTANT NOTICE: Please read these Terms carefully before using MindBridge. By accessing or using MindBridge, you agree to be bound by these Terms and Conditions. MindBridge is a personal growth and mental clarity platform — it is NOT a licensed therapy service or clinical treatment program. If you are experiencing a mental health emergency, please contact emergency services or a crisis line immediately.

1. About MindBridge

MindBridge is a personal development and mental clarity platform operated by InsightCrossing, Inc. ("MindBridge," "we," "us," or "our"). MindBridge provides AI-assisted journaling, guided reflection exercises, and wellness tools informed by evidence-based frameworks including Ericksonian, Jungian, and Rogerian approaches.

All AI-facilitated sessions on MindBridge are provided under the oversight of a licensed mental health professional (currently a Licensed Master Social Worker, LMSW) who reviews sessions and monitors for risk indicators. This oversight is a cornerstone of our platform's integrity.

2. Not a Substitute for Clinical Care

MindBridge is NOT a mental health treatment service. Your use of MindBridge does not constitute or establish a therapist-client relationship, a doctor-patient relationship, or any other clinical relationship.

MindBridge is not appropriate for:

Diagnosis or treatment of mental health disorders
Crisis intervention or emergency mental health situations
Replacement of medication management or psychiatric services
Processing active trauma without professional clinical support

If you are in crisis or believe you may be a danger to yourself or others, please contact emergency services (911) or a crisis line such as the 988 Suicide & Crisis Lifeline (call or text 988 in the US) immediately.

3. Eligibility

To use MindBridge, you must:

Be at least 18 years of age
Reside in a jurisdiction where use of this platform is permitted
Have the legal capacity to enter into a binding agreement
Complete the intake screening process honestly and completely

By registering, you represent and warrant that you meet all eligibility requirements. MindBridge reserves the right to terminate your account if we determine that you do not meet these requirements or have provided false information.

4. User Accounts and Registration

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to:

Provide accurate, current, and complete information during registration
Update your information to keep it accurate and current
Notify us immediately of any unauthorized use of your account
Not share your account credentials with any other person

MindBridge reserves the right to suspend or terminate accounts that we believe are being used fraudulently or in violation of these Terms.

5. Membership Tiers and Payment

5.1 Available Plans

MindBridge currently offers three membership tiers: Reflect, Align, and Integrate. Each tier provides access to different platform features as described on our pricing page. Features and pricing are subject to change with advance notice.

5.2 Billing

Membership fees are billed on a recurring monthly basis via Stripe. By subscribing, you authorize InsightCrossing, Inc. to charge your payment method on a recurring basis until you cancel your subscription.

5.3 Cancellations and Refunds

You may cancel your membership at any time. Cancellation will take effect at the end of your current billing period. We do not provide pro-rated refunds for partial months. If you believe a charge was made in error, please contact us within 30 days at support@mindbridge.app.

5.4 Free Trials

If a free trial is offered, it will be clearly stated at the time of registration. At the conclusion of the trial period, your account will automatically convert to a paid subscription unless you cancel before the trial ends.

6. Privacy and Data

Your use of MindBridge is also governed by our Privacy Policy, which is incorporated by reference into these Terms. By using MindBridge, you consent to the collection and use of information as described in the Privacy Policy.

You understand and agree that:

Your session content may be reviewed by a licensed supervising professional as part of our oversight model
AI-generated responses are not created by a human therapist in real time
De-identified and aggregated data may be used to improve the platform
We maintain appropriate safeguards for your personal information consistent with applicable law

7. Professional Oversight

A core feature of MindBridge is the integration of licensed professional oversight into the AI experience. A supervising licensed mental health professional (currently an LMSW) reviews session data, monitors for risk indicators, and may reach out to you directly if a concern is identified. This oversight is provided as a platform safety feature and does not constitute clinical treatment.

MindBridge reserves the right to pause or terminate your access if the supervising professional determines that continued platform use is not in your best interest, or if your situation requires a level of care that MindBridge cannot appropriately provide.

8. AI-Generated Content

MindBridge uses artificial intelligence to generate reflective prompts, responses, and summaries. You understand and agree that:

AI-generated content is informational and supportive in nature, not clinical advice
AI responses may contain errors, omissions, or content that is not applicable to your situation
You retain full responsibility for decisions you make based on platform content
MindBridge is continuously improving its AI systems and response quality

You should not rely on AI-generated content as a substitute for professional judgment in matters of health, safety, legal, or financial decisions.

9. Acceptable Use

You agree to use MindBridge only for lawful personal development purposes. You agree NOT to:

Use the platform to harm yourself or others
Submit false or misleading information
Attempt to reverse-engineer, scrape, or copy platform systems or content
Use the platform for commercial purposes without our written consent
Attempt to circumvent safety screening mechanisms
Harass, threaten, or abuse platform staff or oversight professionals

Violation of acceptable use policies may result in immediate account termination without refund.

10. Crisis and Safety Protocols

MindBridge includes intake screening and ongoing monitoring for indicators of risk. If our systems or supervising professional identify a potential safety concern, we may:

Provide crisis resources and referral information
Pause your access to the platform
Attempt to contact you directly
In limited circumstances, contact emergency services if we believe there is imminent risk of harm

By using MindBridge, you acknowledge and consent to these safety protocols. You understand that MindBridge does not guarantee a crisis response capability and is not a substitute for emergency services.

11. Intellectual Property

All platform content, including but not limited to software, design, text, graphics, therapeutic frameworks as implemented on the platform, and AI systems, are the property of InsightCrossing, Inc. or its licensors and are protected by applicable intellectual property laws.

You retain ownership of personal content you submit to the platform (such as journal entries). By submitting content, you grant InsightCrossing, Inc. a limited, non-exclusive license to process and display that content for the purpose of providing the service to you.

12. Disclaimers

MindBridge is provided on an "as is" and "as available" basis without warranties of any kind, express or implied. We do not warrant that the platform will be uninterrupted, error-free, or free from harmful components.

To the fullest extent permitted by applicable law, InsightCrossing, Inc. disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

13. Limitation of Liability

To the fullest extent permitted by applicable law, InsightCrossing, Inc. and its officers, directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the platform.

In no event shall our total liability exceed the amount paid by you to MindBridge in the twelve (12) months preceding the claim.

14. Indemnification

You agree to indemnify, defend, and hold harmless InsightCrossing, Inc. and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising from: (a) your use of the platform; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any content you submit to the platform.

15. Modifications to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or a prominent notice on the platform at least 14 days before taking effect. Continued use of the platform after the effective date of updated Terms constitutes your acceptance of the changes.

16. Governing Law and Dispute Resolution

These Terms shall be governed by the laws of the State of Delaware, without regard to its conflict of laws principles. Any dispute arising from these Terms or your use of MindBridge shall be resolved through binding arbitration in accordance with the American Arbitration Association's Consumer Arbitration Rules, except that either party may seek injunctive or other equitable relief in a court of competent jurisdiction.

You waive any right to participate in a class action lawsuit or class-wide arbitration related to your use of MindBridge.

17. Termination

Either party may terminate this agreement at any time. You may terminate by canceling your account. We may terminate or suspend your access immediately, without prior notice, for conduct that we determine violates these Terms, is harmful to other users, us, or third parties, or for any other reason at our discretion.

Upon termination, your right to use the platform ceases immediately. Provisions that by their nature should survive termination will survive, including Sections 6, 8, 11, 12, 13, 14, and 16.
